These Terms of Service (the “Terms”) govern access to and use of the RateMyPay website, platform, applications, tools, content, features, reports, and related services (collectively, the “Services”). Please read these Terms carefully. By accessing or using the Services, creating an account, purchasing a subscription or other paid service, or otherwise indicating acceptance of these Terms, you agree to be bound by these Terms and by the RateMyPay Privacy Policy. If you do not agree to these Terms, do not use the Services.
1. About RateMyPay
RateMyPay is a compensation intelligence platform designed to help individuals better understand compensation and career opportunities and to help organizations make more informed compensation decisions.
Depending on the product or subscription selected, the Services may include salary and compensation insights, market comparisons, career information, job opportunities, job descriptions, job architecture, job matching, job evaluation, compensation benchmarking, salary structures, compensation planning, performance and reward tools, total rewards statements, compensation analytics, and related functionality.
In these Terms, “RateMyPay,” “we,” “us,” and “our” refer to the legal entity that operates RateMyPay.
2. Eligibility and Authority
You may use the Services only if you are legally capable of entering into a binding agreement in the jurisdiction where you reside. Unless RateMyPay expressly states otherwise for a particular service, you must be at least 18 years old to create an account or purchase a paid service.
If you access or use the Services on behalf of a corporation, partnership, employer, consulting firm, government body, or other organization, you represent and warrant that you have authority to bind that organization to these Terms. In that case, references to “you” include both you and the organization you represent.
3. Accounts and Account Security
Certain Services require an account. You agree to provide accurate, current, and reasonably complete information when creating and maintaining your account.
You are responsible for safeguarding your login credentials, controlling access to your account, and all activity that occurs under your account. You must promptly notify RateMyPay if you know or reasonably suspect that your credentials have been compromised or that your account has been accessed without authorization.
You may not impersonate another person, create an account using materially false information, share credentials with unauthorized persons, or access another user’s account without permission. RateMyPay may suspend or restrict an account where we reasonably believe there has been fraud, misuse, unauthorized access, a security risk, or a material breach of these Terms.
4. Individual Services
RateMyPay may provide individuals with compensation, career, and labour-market information based on information provided by the user, available market information, third-party sources, public information, RateMyPay methodologies, algorithms, statistical models, and other relevant inputs.
Depending on the feature used, outputs may include estimated market compensation, salary ranges, compensation comparisons, pay-positioning information, compensation assessments, career insights, market trends, and job opportunities.
These outputs are informational and decision-support tools. They are not promises, guarantees, or binding determinations of compensation or employment outcomes.
5. Compensation Information Is Indicative
Compensation is affected by many variables, including job responsibilities, career level, scope, experience, education, skills, certifications, geography, industry, organization size, labour-market conditions, internal compensation practices, performance, business conditions, and individual circumstances.
Accordingly, compensation information provided through RateMyPay may differ from actual employer compensation, survey results, recruiter estimates, government information, compensation websites, or compensation later negotiated by a user.
RateMyPay does not warrant that a salary estimate, range, benchmark, market value, rating, percentile, or other compensation result will be complete, current, suitable for every purpose, or applicable to every person or employer.
6. No Guarantee of Salary, Employment, or Career Outcome
RateMyPay does not guarantee that you will receive a particular salary, a pay increase, a promotion, a job interview, a job offer, employment, or any other career outcome.
RateMyPay does not guarantee that an employer will agree with a RateMyPay assessment, that a listed opportunity will remain open, or that taking any particular action based on RateMyPay information will produce a specific result.
You should consider RateMyPay as one source of information and apply your own judgment to compensation and career decisions.
7. No Legal, Tax, Financial, Immigration, or Other Regulated Advice
The Services provide information and technology tools. Unless expressly stated in a separate written engagement, RateMyPay does not provide legal, tax, accounting, investment, financial-planning, immigration, or other regulated professional advice.
You are responsible for obtaining independent professional advice where appropriate.
8. RateMyPay Business
RateMyPay Business may provide tools for employers, human resources teams, compensation professionals, consultants, and other authorized organizational users. Features may include job-description management, job architecture, job matching, market benchmarking, job evaluation, salary structures, compensation planning, merit and performance tools, total rewards statements, and compensation analytics.
Business Services may be subject to an order form, subscription agreement, statement of work, master services agreement, data processing agreement, service-level commitment, or other written agreement. If a signed agreement between RateMyPay and a business customer conflicts with these Terms, the signed agreement governs to the extent of the conflict.
9. Responsibility for Employment and Compensation Decisions
RateMyPay provides tools and information intended to support, not replace, human judgment. Organizations remain solely responsible for their compensation, hiring, promotion, performance, classification, termination, benefits, pay-equity, equal-pay, and other employment decisions.
Organizations are responsible for reviewing RateMyPay outputs in light of their own policies, data, compensation philosophy, business circumstances, contractual commitments, and legal obligations.
Use of RateMyPay does not make RateMyPay the employer, co-employer, agent, fiduciary, or decision-maker with respect to a customer’s workforce.
10. Artificial Intelligence and Automated Features
RateMyPay may use artificial intelligence, machine learning, statistical models, algorithms, or other automated technologies to support features such as job-description analysis, job matching, job leveling, job classification, market analysis, compensation insights, search, drafting, and pattern recognition.
Automated outputs may contain errors, omissions, inconsistencies, or recommendations that are not appropriate for a particular situation. RateMyPay does not represent that AI-generated or algorithmic outputs are infallible, unbiased, complete, or suitable for use without review.
Users are responsible for reviewing outputs before relying on them, particularly where an output may affect compensation, employment, promotion, performance, or other significant decisions.
11. Human Review of Material Employment Decisions
Business customers should maintain appropriate human review before using RateMyPay outputs to make or materially influence decisions concerning compensation, hiring, promotion, demotion, performance, termination, eligibility for benefits, or other significant employment outcomes.
Nothing in the Services is intended to relieve an employer of obligations that may apply to automated employment decision tools, profiling, workplace privacy, anti-discrimination, human-rights, equal-pay, or pay-transparency laws.
12. Customer and User Content
You may submit information or content to the Services, including job information, compensation information, employment history, resumes, job descriptions, organizational structures, employee information, compensation structures, market data, survey information, documents, comments, and other materials (“User Content”).
As between you and RateMyPay, you retain ownership of User Content that you own before submitting it. You grant RateMyPay a non-exclusive, worldwide, royalty-free right to host, store, copy, process, analyze, transmit, transform, display, and otherwise use User Content solely as reasonably necessary to provide, secure, maintain, support, and improve the Services, subject to the Privacy Policy and any applicable business agreement.
You are responsible for the accuracy, legality, and appropriateness of User Content you submit.
13. Authority to Submit Information
You represent and warrant that you have all rights, permissions, consents, and legal authority necessary to provide User Content to RateMyPay and to permit RateMyPay to process it for the purposes described in these Terms, the Privacy Policy, and any applicable agreement.
You must not submit information that you are not authorized to disclose, that unlawfully infringes another person’s privacy or intellectual-property rights, that breaches a duty of confidentiality, that contains malicious code, or that is fraudulent or intentionally misleading.
Business customers are responsible for establishing an appropriate legal basis for providing employee, applicant, compensation, or workforce information to RateMyPay.
14. Confidential Business Information
Business customers may provide confidential compensation, employee, organizational, or workforce information. RateMyPay will handle such information in accordance with these Terms, the Privacy Policy, applicable law, and any additional written agreement with the customer.
Where an enterprise agreement contains more specific confidentiality, security, retention, or data-processing provisions, those provisions will govern for that customer.
15. Aggregated and De-identified Information
RateMyPay may create aggregated, statistical, or de-identified information derived from use of the Services. Where information has been processed so that it is no longer reasonably associated with an identifiable individual or customer, RateMyPay may use that information for benchmarking, research, analytics, product development, service improvement, compensation insights, labour-market analysis, and market reporting.
RateMyPay will not attempt to re-identify information that has been de-identified except where permitted by law for legitimate purposes such as testing de-identification methods, security, or fraud prevention.
16. Market Data and Third-Party Information
The Services may incorporate information from market surveys, data vendors, government sources, public sources, recruitment platforms, job postings, customers, users, and other third parties.
Third-party information may be incomplete, delayed, inaccurate, unavailable, or subject to restrictions imposed by its provider. RateMyPay does not guarantee the accuracy, completeness, or continued availability of third-party data.
17. Job Listings and External Opportunities
RateMyPay may display or link to job opportunities made available by employers, recruiters, job boards, or other third parties.
Unless expressly stated otherwise, RateMyPay does not control those opportunities and does not guarantee that a job remains open, that an employer’s description or compensation information is accurate, that an employer will respond, or that a user will be hired.
Applications or interactions occurring on third-party services are governed by the third party’s terms and privacy practices.
18. Free and Paid Services
RateMyPay may offer free features, one-time purchases, subscriptions, enterprise services, or other paid offerings. Pricing may vary by product, module, number of users, number of employees, usage, reporting package, contract term, or other factors.
The price, billing frequency, included services, applicable taxes, and material purchase terms will be disclosed before purchase or documented in an applicable order form.
19. Automatic Renewal
If you purchase a subscription that renews automatically, the renewal terms, billing frequency, and price will be disclosed before you complete the purchase.
Unless otherwise stated, an automatically renewing subscription continues for successive billing periods until cancelled in accordance with these Terms or the applicable order form.
By choosing an auto-renewing subscription, you authorize RateMyPay or its payment processor to charge the payment method on file for each renewal period, subject to applicable law and any required renewal notices.
20. Free Trials and Promotional Offers
RateMyPay may offer trials, introductory pricing, promotional credits, discounts, or other offers. Additional terms may apply to those offers.
If a trial converts automatically to a paid subscription, RateMyPay will disclose the trial duration, post-trial price, billing frequency, renewal terms, and cancellation method before enrollment.
Promotions may be limited by time, geography, account, product, or eligibility criteria and may be modified or discontinued where permitted by law.
21. Cancellation
You may cancel a consumer subscription using the cancellation method made available through your account or otherwise communicated at purchase.
Unless required by law or expressly stated otherwise, cancellation prevents future renewal but does not retroactively refund a billing period already purchased. Access may continue until the end of the current paid term.
Enterprise and business customers are subject to the cancellation and non-renewal provisions of their applicable agreement or order form.
22. Fees, Taxes, and Price Changes
Fees are stated in the applicable currency shown at purchase and may exclude sales, use, value-added, goods and services, harmonized sales, or other applicable taxes unless stated otherwise.
You are responsible for taxes or government charges associated with your purchase except taxes imposed on RateMyPay’s income.
RateMyPay may change prices prospectively. Where required by law or contract, we will provide advance notice before a price change applies to an existing subscription.
23. Payment Processing
Payments may be processed by a third-party payment service provider. RateMyPay may not directly receive or store complete payment-card information.
Your use of a payment provider may also be subject to that provider’s terms and privacy policy.
24. Refunds
Except where required by applicable law, expressly stated at purchase, or agreed in writing, fees paid to RateMyPay are non-refundable.
Nothing in these Terms limits any mandatory cancellation, refund, cooling-off, chargeback, or consumer-protection right that cannot lawfully be waived.
25. Acceptable Use
You may use the Services only for lawful purposes and in accordance with these Terms. You must not use the Services to violate law, infringe intellectual-property rights, unlawfully obtain personal or confidential information, discriminate unlawfully, commit fraud, introduce malicious code, interfere with service operation, bypass access controls, exploit security vulnerabilities, or access information you are not authorized to access.
You must not scrape, harvest, systematically extract, reverse engineer, copy, resell, sublicense, or commercially exploit the Services, RateMyPay data, or RateMyPay content except as expressly permitted in writing or to the extent such restriction is prohibited by applicable law.
You must not use automated means in a manner that creates an unreasonable technical burden, circumvents rate limits, or attempts to reproduce a substantial portion of RateMyPay’s data or functionality.
26. Prohibited Employment Uses
You must not use RateMyPay in a manner that violates applicable employment, labour, human-rights, anti-discrimination, equal-pay, pay-equity, pay-transparency, privacy, data-protection, or automated-decision laws.
Business customers remain responsible for determining whether and how the Services may lawfully be used in each jurisdiction where they operate.
27. Intellectual Property
Except for User Content and third-party materials, RateMyPay and its licensors own all right, title, and interest in and to the Services and related intellectual property, including software, interfaces, designs, trademarks, logos, methodologies, models, algorithms, reports, documentation, databases, compilations, text, graphics, workflows, and platform architecture.
No ownership rights are transferred to you by these Terms.
28. Limited Licence
Subject to these Terms and payment of applicable fees, RateMyPay grants you a limited, non-exclusive, non-transferable, non-sublicensable, revocable right to access and use the Services for their intended purpose during the applicable subscription or access period.
Any rights not expressly granted are reserved by RateMyPay and its licensors.
29. RateMyPay Name and Branding
The RateMyPay name, logo, product names, trade dress, and related branding are trademarks or proprietary assets of the entity operating RateMyPay.
You may not use RateMyPay branding in a manner that suggests sponsorship, endorsement, partnership, certification, or affiliation without prior written permission.
30. Feedback
If you voluntarily provide ideas, suggestions, recommendations, or feedback concerning RateMyPay, you grant RateMyPay a perpetual, irrevocable, worldwide, royalty-free right to use and incorporate that feedback without compensation or restriction.
This clause does not transfer ownership of confidential business information submitted under a separate confidentiality obligation.
31. Service Availability and Changes
RateMyPay may add, modify, replace, or discontinue features; update methodologies or data sources; change interfaces; or introduce new services from time to time.
The Services may be unavailable temporarily because of maintenance, security events, software updates, provider outages, infrastructure failures, or circumstances outside RateMyPay’s reasonable control. RateMyPay does not guarantee uninterrupted or error-free operation.
32. Beta, Pilot, Preview, and Early-Access Features
Certain features may be identified as beta, pilot, preview, early access, or experimental. Such features may be incomplete, contain errors, change materially, or be discontinued without notice.
Unless RateMyPay expressly agrees otherwise in writing, beta or preview features should not be relied upon for critical business or employment decisions.
33. Third-Party Services and Integrations
The Services may link to or integrate with third-party services, including human-resources systems, payroll systems, job boards, cloud providers, analytics tools, payment providers, authentication providers, and other software.
RateMyPay is not responsible for third-party products or services that it does not control. Your use of those services may be governed by separate terms and privacy policies.
34. Privacy
RateMyPay’s collection, use, disclosure, retention, and protection of personal information are described in the RateMyPay Privacy Policy.
Business customers that provide workforce information to RateMyPay may have additional obligations under applicable privacy, employment, workplace-surveillance, or data-protection laws and under any data processing agreement with RateMyPay.
35. Security
RateMyPay uses administrative, technical, and organizational safeguards designed to protect the Services and information processed through them. No information system can be guaranteed to be completely secure.
You are responsible for maintaining appropriate account security, protecting credentials, controlling authorized users, using secure devices and networks, and promptly reporting suspected unauthorized access.
36. Suspension
RateMyPay may suspend or restrict access where reasonably necessary to protect security, investigate suspected fraud or misuse, prevent harm, comply with law, address non-payment, respond to unauthorized access, or enforce these Terms.
Where appropriate and legally permitted, RateMyPay will provide notice of suspension and an opportunity to address the underlying issue.
37. Termination
You may stop using RateMyPay at any time. Paid subscriptions remain subject to their cancellation and payment terms.
RateMyPay may terminate or restrict access if you materially breach these Terms, fail to pay amounts when due, engage in fraud or abuse, create material security or legal risk, use the Services unlawfully, or where continued service is prohibited by law.
RateMyPay may also discontinue a Service. Where a discontinuation materially affects a paid service, RateMyPay will provide notice where reasonably practicable or legally required.
38. Effect of Termination
Upon termination, your right to use the affected Services ends, subject to any continued access expressly provided for the remainder of a paid term.
Information may be deleted, retained, returned, or exported in accordance with the Privacy Policy, applicable law, and any applicable business agreement. Unpaid amounts remain due, and provisions that by their nature should survive termination remain in effect.
39. Disclaimers
To the fullest extent permitted by applicable law, the Services are provided on an “as is” and “as available” basis.
RateMyPay does not warrant that the Services will be uninterrupted, error-free, free from harmful components, or suitable for every user, or that every compensation estimate, benchmark, job match, recommendation, classification, report, or third-party data point will be accurate, complete, current, or fit for a particular purpose.
Nothing in these Terms excludes any warranty, condition, guarantee, or consumer right that cannot lawfully be excluded.
40. Limitation of Liability
To the fullest extent permitted by applicable law, RateMyPay and its affiliates, directors, officers, employees, contractors, licensors, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of profits, revenue, business opportunity, goodwill, data, or anticipated savings arising out of or relating to the Services.
This limitation includes, where permitted by law, losses arising from employment decisions, compensation decisions, lost employment opportunities, business interruption, reliance on RateMyPay outputs, or third-party services.
41. Non-Excludable Rights
Some jurisdictions do not permit certain exclusions, waivers, or limitations of liability. Nothing in these Terms limits a right or remedy that cannot lawfully be waived or excluded. Any limitation in these Terms applies only to the maximum extent permitted by applicable law.
42. Indemnification
To the extent permitted by law, organizational and business users agree to indemnify, defend, and hold harmless RateMyPay and its affiliates, directors, officers, employees, and contractors from third-party claims, liabilities, damages, and reasonable costs arising from the customer’s unlawful use of the Services, information submitted without authority, employment decisions, violation of applicable law, or material breach of these Terms.
Enterprise agreements may contain different or reciprocal indemnification provisions and will govern for the relevant customer.
43. Changes to These Terms
RateMyPay may update these Terms to reflect changes in the Services, law, business operations, pricing models, security practices, or other legitimate operational needs.
The “Last Updated” date will identify the most recent version. Where changes are material or notice is required by law, RateMyPay may provide notice by email, account message, website notice, or another reasonable method.
If required by applicable law, RateMyPay will obtain renewed consent before applying a material change.
44. Electronic Communications and Notices
To the extent permitted by law, you agree that RateMyPay may provide agreements, disclosures, notices, and other communications electronically, including by email, account message, website notice, or in-product notification.
You are responsible for maintaining a current email address associated with your account.
45. Consumer Rights
Nothing in these Terms is intended to waive, limit, or contract out of rights that consumers have under mandatory applicable law.
Consumer rights may vary by province, territory, state, and country. If these Terms conflict with a mandatory consumer-protection requirement, the mandatory requirement will control to the extent of the conflict.
46. Governing Law
These Terms and any dispute arising out of or relating to your use of RateMyPay will be governed by the laws applicable to the jurisdiction in which RateMyPay provides services to you, without regard to conflict-of-law principles.
If you are located in Canada, these Terms will be governed by the laws of the Canadian province in which the RateMyPay contracting entity is established, together with the applicable federal laws of Canada.
If you are located in the United States, these Terms will be governed by the laws of the U.S. state in which the RateMyPay contracting entity is established, together with applicable federal laws of the United States.
Nothing in this section is intended to limit or exclude any mandatory rights or protections available to you under the consumer protection, privacy, employment, or other laws of your province, territory, state, or other jurisdiction where those rights cannot lawfully be waived.
Where RateMyPay enters into a separate written agreement with a business customer, the governing law stated in that agreement will apply to the matters covered by that agreement.
47. Assignment
You may not assign these Terms or transfer your rights under them without RateMyPay’s prior written consent, except where applicable law provides otherwise.
RateMyPay may assign these Terms in connection with a merger, acquisition, financing, corporate reorganization, sale of assets, or transfer of the RateMyPay business, subject to applicable law.
48. Severability
If any provision of these Terms is held to be unlawful or unenforceable, that provision will be enforced to the maximum extent permitted and the remaining provisions will remain in effect.
49. No Waiver
A failure or delay by RateMyPay to enforce a provision of these Terms does not waive the right to enforce that provision or any other provision later.
50. Entire Agreement and Order of Precedence
These Terms, together with the Privacy Policy and any applicable order form, enterprise agreement, data processing agreement, statement of work, subscription terms, or other incorporated document, constitute the agreement governing your use of the applicable Services.
Where an executed business agreement expressly conflicts with these Terms, the executed business agreement will control for that customer to the extent of the conflict.
